7. SPECIFIC CONDITIONS OF SERVICE.
7.1. CONTRACTUAL PROCESS.
The contractual process carried out through the Website involves the following steps:
- Select the hotel, offer, or room on the home page using search parameters, as well as the dates of your stay.
- Choice of room type and number of people.
- The customer will be redirected to a page outside the Website to enter personal information related to the reservation, as well as the bank card used to guarantee the reservation, and to accept the general reservation conditions.
- The reservation will be formalized by displaying the confirmation page.
- Sending a reservation confirmation email with details of the reservation.
Upon formalizing the reservation, an electronic document will be generated and subsequently added to MASAYA's files. The User will have full access to and knowledge of the document at all times through an email containing its contents upon completion of the reservation process.

7.2. APPLICABLE LEGISLATION.
The relationship between the website owner and Users shall be governed by Colombian law.
7.3. RESERVATION.
- The client selects the services offered on the Website; they acknowledge that they are aware of the nature, purpose, and booking methods for the available services. They also acknowledge that they have requested and obtained the necessary or additional information to make the reservation with full knowledge of the facts.
- When making a reservation, the customer must enter their card details as a guarantee.
- For group reservations, please contact the auberge de jeunesse directly.
- The client is solely responsible for the choice of services and their suitability for their needs, so MASAYA cannot be held liable for these reasons.
- Upon completion of the reservation process, the customer will be deemed to have fully accepted it.
- Masaya considers the service to begin upon reservation confirmation, as from that moment on, accommodation inventory is blocked, experience preparation is activated, and personalized follow-up is established. Therefore, any refund request will be evaluated solely under the conditions of the selected rate type.
7.4. PRICE OF SERVICES.
- The prices for our services are subject to change without prior notice. This does not apply to reservations already confirmed, except for changes in legal or regulatory taxes established by the competent authorities.
- We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice and without giving rise to any compensation.
- We will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
- Colombian residents must pay a 19% VAT on the value of their stay, an amount not included in the final reservation rate. Foreigners and non-resident Colombians are exempt from VAT only if the purpose of their trip is:
- Receive medical treatment.
- Rest or leisure activities as a tourist.
- Attend or participate in cultural, scientific, or sporting events, conventions, or business.
- Groups of tourists in transit on a cruise ship. For these purposes, their passport must be stamped with the TP code and be valid for 90 days.
- The Guest will be responsible for all consumption that corresponds to him/her and that occurs during his/her stay.
- During check-in, the hotel may require a deposit and a credit card as a guarantee of payment. The Guest authorizes MASAYA Hotel to use their credit card to pay the total bill.
7.5. PAYMENT METHODS.
At check-in and once the reservation has been verified, MASAYA will ask the Client to make payment through the following means: cash or credit or debit cards issued by Colombian or foreign financial institutions corresponding to one of these brands:
The services offered on the Website, unless otherwise specified for specific cases or offers of certain services, can only be paid for using the means specifically indicated in each case.
The Website may specify certain payment terms depending on the payment method used by the Visitor and/or User.
7.6. RIGHT OF WITHDRAWAL.
Users of the Website have the possibility of exercising the right to withdraw their purchase or reservation, that is, they can request the reversal of the purchase or reservation. in accordance with current legislation.
MASAYA will refund the money without deductions of any kind, by bank deposit to the account from which the payment was made, or the one authorized by the buyer, in no more than thirty (30) calendar days from the moment in which the right was exercised.
To exercise the right of withdrawal, you must contact the customer service channels provided in this document.
7.7. PAYMENT REVERSAL.
The law provides that, in sales made through electronic commerce mechanisms, such as the Internet, and where a credit, debit card, or any other electronic payment instrument is used to make the payment, the participants in the payment process must reverse payments requested by the consumer when they are the subject of fraud or correspond to an unsolicited transaction.
For the payment reversal to proceed, within five (5) business days following the date on which the consumer became aware of the fraudulent or unsolicited transaction, the consumer must file a complaint with the supplier and notify the issuer of the electronic payment instrument used to make the purchase, which, together with the other participants in the payment process, will proceed to reverse the transaction to the buyer.
7.8. CANCELLATION AND MODIFICATION POLICY.
Reservations can be cancelled or modified no later than 48 hours before the check-in date.
On Show: A reservation is considered a no-show when the guest does not show up at the hotel on the scheduled check-in date and has not previously arranged the cancellation through official channels. In these cases, a fee for the full amount of the reservation will be applied, which will be charged to the registered payment method or according to the terms and conditions of the channel used. These items are not taxable; VAT is not charged. By making a reservation, the guest authorizes Masaya to charge this fee in accordance with the terms and conditions accepted at the time of confirmation.
Late cancellation: When a flexible rate reservation is canceled less than 48 hours before check-in (local hotel time), it is considered a late cancellation. In these cases, a fee equivalent to the total reservation value will be applied, which will be charged to the registered payment method or according to the conditions of the channel used. If the reservation is for more than two nights, the maximum amount of the first two nights of the reservation will always be charged. Reservations with non-refundable rates cannot be canceled at any time; therefore, the "late cancellation" category does not apply to this type of rate. These items are not taxable; VAT is not charged.
7.9. REGULATIONS OF EACH HOTEL.
Each Masaya hotel has its own rules and regulations. By making a reservation, the guest agrees to abide by them for the duration of their stay at the establishment. Any behavior that violates these rules, good manners, or public order may result in the hotel asking the guest to leave the establishment without compensation or any refund if a charge has already been made.
7.10. LOSSES AND DAMAGES.
- MASAYA, its employees, and contractors will not be liable for personal accidents, loss, theft, or damage to its clients' belongings. We recommend purchasing travel insurance.
- The Guest will be responsible for any loss or damage caused to items in the room, room access cards, or any other hotel property, specifying that the price will be charged to the room account.
7.11. ENTRANCE AND EXIT.
CHECK-IN: Starting at 15:00 PM, guests can arrive early to the hotel to enjoy the common areas or leave their luggage while they check in to their room.
MASAYA reserves the right of admission.
CHECK-OUT: Until 11:00 AM, unless otherwise expressly agreed upon, the guest must vacate the room by 11:00 AM on the day of the reservation's end. Failure to do so will result in an additional night's charge.
7.12. VISIT TO THE GUEST.
If a room visit is required, the guest must report to the hotel reception desk and present their ID. However, visits are only permitted in social areas until 22:00 PM. If the guest wishes to stay, they must pay or charge the corresponding room rate. Guests are responsible for the proper use of the accommodations and the actions of their companions.
7.13. MINOR REGISTRATION POLICY.
If you are traveling with your child(ren) under 18 years of age, you must present the minor's identification document (civil registry) that proves said relationship. If the minor(s) are not traveling accompanied by their parents, you must submit to the reception, in addition to the minor's identification document (civil registry), the parental permission, which must be authenticated by a notary and accompanied by a copy of the identification document of those who gave the authorization. Without this documentation, minors are not permitted to enter the hotel. This is in accordance with the provisions of Law 679 of 2001, the Statute to Prevent the Sexual Exploitation of Children and Adolescents, and its concordant regulations.
7.14. PRACTICE OF SPORTS AND RISKY ACTIVITIES.
Participating in sports or extreme physical activity that poses a risk to Guests implies that Guests have sufficient skills and knowledge. Guests therefore assume full responsibility in the event of any accident, damage, or injury. The hotel is therefore expressly exonerated from any liability for these reasons.
7.15. VOLUME.
The Guest agrees not to play music at levels that disturb the peace of others or nature. In the event of a violation of any rule in these terms and conditions or the regulations of each hotel, MASAYA may immediately cancel the reservation without reimbursement to the Guest. The Guest will also be directly responsible for paying any fine or penalty imposed by the competent authorities for violating the noise level.
7.16. PET FRIENDLY.
We're proud to be a pet-friendly destination. We love welcoming our furry guests and considering them part of the experience. To achieve this, please adhere to the following guidelines:
- Pets (domestic animals - dogs and cats) are only allowed in private rooms.
- The guest acknowledges and accepts payment of the daily rate (COP $60.000 - USD $15) due at check-in, to which the corresponding VAT will be applied as applicable in accordance with current tax regulations.
- Each property has basic amenities for your pet's stay; please request them when making your reservation or during check-in.
- It is the pet owner's responsibility to carry a valid vaccination record, which must comply with the health regulations required by law.
- Pets are not allowed to be left unattended without proper supervision. Pets must be kept on a leash or in a carrier at all times.
- If you need to leave your pet alone in the room, please notify the front desk to schedule cleaning, and use the "do not disturb" sign to prevent hotel/auberge de jeunesse staff from entering the room.
- A responsible adult must be present during room cleaning.
- Guests are not permitted to bring their pets into common areas, such as restaurants, bars, pools, or beaches, unless they are guide or service pets.
- The Guest is responsible for disposing of his or her pet's waste.
- If your pet damages furniture, room furnishings, or items such as towels or pillows, a charge will be made for the replacement or repair of these damaged items.
- The Guest agrees to pay for any charges for repairs, cleanings, and/or damages caused by the pet, as well as any damages or injuries to third parties, such as employees, visitors, or other guests.
- The Guest is responsible for the pet's behavior and must ensure that it does not disrupt or affect the rest and tranquility of other guests and visitors. If it is determined that the pet is disturbing the interaction with other guests, the pet may be housed off-property.
- In accordance with Law 746 of 2002, MASAYA reserves the right of admission for large, medium or highly dangerous breeds.
- Guests with pets accept full responsibility for all property damage and/or personal injury resulting from their pet, and agree to indemnify and hold harmless the hotel, its managers, owners, operators, and collaborators from all liability and damages suffered as a result of the guest's pet.
7.17. TRAFFICKING IN FAUNA AND FLORA.
At MASAYA, we are committed to promoting actions and practices that promote environmental conservation, cultural heritage, the optimization of natural resources, and compliance with current legislation in the tourism sector. We therefore prevent the illegal trade and trafficking of flora, fauna, and cultural assets (Law 17 of 1981 and Law 397 of 1997).
In Colombia, illegal trafficking of flora and fauna species is penalized.
7.18. PROTECTION OF CULTURAL PROPERTY.
In accordance with Law 1185 of 2008, at MASAYA we fight and denounce any situation that may give rise to the illegal trafficking of cultural property.
7.19. SUBSTANCES AND WEAPONS.
Smoking is prohibited in guestrooms and social areas (Law 1335 of 2009) and is only permitted in designated areas. The entry of alcoholic beverages is prohibited. Drug use is illegal and prohibited on hotel premises, as is the possession of weapons.
Failure to comply with any of the above provisions will result in the automatic termination of the accommodation contract without refunds and will result in a fine of THREE HUNDRED THOUSAND COLOMBIAN PESOS $300.000 COP.
7.20. PROHIBITION OF SEX TOURISM.
In accordance with Law 679 of August 3, 2001, which establishes provisions to prevent and counteract the exploitation, pornography, and sexual tourism of minors; specifically in accordance with the provisions of Article 17 and, in accordance with the company's commitment to protecting children and adolescents, MASAYA warns the User that the sexual exploitation and abuse of minors is criminally punishable in Colombia. All crimes will be reported to the corresponding authorities.

8.1. PERSONAL INFORMATION WE COLLECT.
When you make a reservation or attempt to make a reservation through the Website, we collect certain information about you, including your name, billing address, payment information, email address, phone number, nationality, and other information.

9. GUEST OBLIGATIONS.
- Identify yourself to check in at the hotel with an identity document that MASAYA deems appropriate.
- Return the room in the same condition as when it was delivered.
- Do not sublease, transfer or assign the accommodation contract.
- Promptly notify the hotel of any damage that may occur in the hotel's facilities and services.
- Taking care of hotel facilities that deteriorate due to your omission or negligence will be your responsibility to cover the cost of repair or replacement.
- Comply with these terms and conditions, as well as the specific regulations of the hotel where you are staying.
10. TERMINATION OF THE CONTRACT.
The hosting contract ends:
- Due to the expiration of the agreed fixed term.
- For breach of any of the parties' obligations. The Guest's breach will not exempt them from paying the full price for the agreed period.
We reserve the right to extend the contract.
11. FINAL PROVISIONS.
- The terms of use set forth in this document, as well as any disputes that may arise regarding their interpretation, use, scope, and termination, are governed by Colombian law.
- To ensure a safe and comfortable environment for everyone, MASAYA reserves the right to accept, reject, or remove any Guest under circumstances that negatively impact the stay of other visitors or violate our policies.
- The loss or damage of any element of the establishment will be charged according to its commercial value.
